§ 1 Scope, customer information

The following general terms and conditions (GTC) regulate the contractual relationship between Stone Grinding Machines & Lapidary Tools Ltd. Austrian branch, Flurweg 9, 8940 Liezen, Austria and the consumers and entrepreneurs who buy goods through our shop. We do not accept any conditions that conflict with or deviate from our terms and conditions. The contract language is German.

§ 2 Process of the order

You order in our shop by
1. Add item to cart
2. call up the shopping cart
3. proceed to checkout
4. Log in with your customer data or create a new customer account
and enter your personal data
5. Select the delivery and billing address
6. select the shipping method and payment method
7. take note of our general terms and conditions and the cancellation policy and confirm this
8. Confirm that your information is correct by clicking on the “Buy Now” button at the end.

You can also conclude your purchase contract by telephone or email by providing the necessary information.

§ 3 Conclusion of contract

(1) The offers on the Internet represent a binding offer to you to purchase goods.

(2) After entering your data and clicking the order button, you accept this offer to conclude a purchase contract. You can also conclude the purchase contract by telephone or email.

§ 4 Customer information: Storage of your order data

Your order with details of the concluded contract (e.g.b Type of product, price etc.) is saved by us. However, you do not have access to your past orders via the Internet. We will send you the General Terms and Conditions, but you can also access the General Terms and Conditions at any time via our website. If you would like to save the product description on our shop page for your own purposes, you can do so at the time of ordering, for example.b Take a screenshot (= screen photograph) or alternatively print out the entire page.

§ 5 Customer information: Correction notice

You can correct your entries at any time before submitting the order using the delete button. We will inform you about further correction options as you go through the ordering process. You can also end the ordering process completely at any time by closing the browser window.

§ 6 Retention of title

The purchased item remains our property until full payment.

§ 7 Prices and shipping costs

7.1 The prices stated on the product pages include statutory sales tax plus shipping costs. Catalog prices only remain valid until a new catalog has been published or the price has been adjusted on the homepage of the respective product. In the event of premature price adjustments to the catalog prices, we will inform you of the new price immediately and free you to purchase the ordered goods at the valid price or to withdraw from your order.

7.2 In addition to the stated prices, we charge shipping costs for delivery based on weight and zone. The shipping costs will be clearly communicated to you on the shipping cost overview, and for orders via the online shop also in the shopping cart system and on the order page. You can use our shipping cost calculator to calculate shipping costs in advance. We deliver worldwide. Due to the shipping cost calculation, orders to Austria, Germany and Switzerland can only be processed via the shop. For deliveries to other countries, please order by telephone or email.

Despite our best efforts, a small number of the products in our catalog may be mispriced. We check prices when we process your order. If a product is mispriced and the correct price is higher than the price on the website, we will of course contact you before dispatching the goods to ask you whether you wish to purchase the product at the correct price or cancel the order . If the correct price of a product is lower than our stated price, we will of course charge the lower amount and ship the product to you.

§ 8 Delivery

8.1 Delivery takes place within Austria to a home address. Deliveries abroad are only made to a home address. We do not cover any customs fees incurred for deliveries abroad and must be borne separately by the buyer.

8.2 The delivery time is 10 working days, provided that the product ordered is marked as being in stock. We expressly point out any different delivery times on the respective product page. The delivery period begins on the day after the payment order is issued to the transferring credit institution and ends on the following tenth day. If the last day of the deadline falls on a Saturday, Sunday or a public holiday recognized by the state at the place of delivery, such a day will be replaced by the next working day.

§ 9 Payment

9.1 Payment is made at the buyer's discretion by advance payment or instant bank transfer.

9.2 If you choose the advance payment method, we will give you our bank details in the order confirmation and deliver the goods, taking into account the stated delivery time after receipt of payment.

If you choose the payment method Sofortüberweisung, please follow the payment instructions after completing the order. Sofortüberweisung is the online payment service with which you can pay for your purchases quickly and easily. You pay with your usual Netbanking access data.

We only offer delivery on account to existing customers. We also reserve the right to refer these customers to a different payment method if we have evidence that questions the customer's ability to pay.

§ 10 Limitation of your warranty claims

(1) Warranty to consumers for used goods

Your claims due to defects in used items expire - regardless of the legal basis - one year from the handover of the sold item to you. Excluded from this regulation are claims due to defects that we fraudulently concealed and claims arising from a guarantee that we have assumed for the quality of the item. For these excluded claims, the statutory limitation periods apply.

(2) Warranty to entrepreneurs

Your warranty claims due to defects in the purchased item expire - regardless of the legal basis - one year from the transfer of risk, whereby you must prove the existence of a defect. Excluded from this regulation are claims due to defects that we fraudulently concealed and claims arising from a guarantee that we have assumed for the quality of the item. For these excluded claims, the statutory limitation periods apply.

§11 Repair conditions

When returning items, the customer must bear the postage costs themselves. We bear the postage costs for repairs (repaired parts, machines) back to the customer. The costs incurred for the repair will be charged if there is no warranty claim.

§ 12 Limitation of liability

We exclude liability for damage caused by minor negligence, provided that this does not concern damage resulting from injury to life, body or health of people or guarantees or claims under the Product Liability Act (PHG). Entrepreneurs within the meaning of the German Commercial Code (UGB) must prove the existence of intent or gross negligence. Liability towards entrepreneurs for lost profits and other consequential damages is excluded.

§ 13 Place of jurisdiction

The exclusive place of jurisdiction for all disputes arising from this contract is our place of business if you are an entrepreneur.

§ 14 Information in accordance with. Section 19 Paragraph 3 Alternative Dispute Resolution Act (AStG)

According to Section 19 Paragraph 3 of the Alternative Dispute Resolution Act (AStG), if we cannot reach an agreement with the consumer in a dispute, we will contact the consumer on paper or another durable medium (e.g.b E-mail) to point out the responsible body for alternative dispute resolution, hereinafter referred to as “AS body”. At the same time, we must indicate whether we will take part in a procedure. The AS office designated for us: Internet Ombudsman http://www.ombudsmann.at

We will take part in this procedure in the following case: Customer receives goods that were damaged during transport.

§ 15 Minors

We do not offer products for purchase by minors. If you are under 18, you may only order with the involvement of a parent or legal guardian.

§ 17 Applicable law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict of laws.

§ 18 No waiver

If you breach these Terms of Sale and we do nothing about it, we will still be entitled to exercise our rights on any other occasion where you breach these Terms of Sale.

§ 19 Changes to the sales conditions

We reserve the right to make changes to our website, rules and conditions, including these Terms of Sale, at any time and for any reason. The conditions of sale, contractual conditions and general terms and conditions in force at the time of your order will apply to your order, unless a change to these conditions is required by law or by official order (in which case they will also apply to orders, that you have previously made). If any provision of these Terms of Sale is found to be invalid, void or for any reason unenforceable, that provision will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
